2.Will that policy potentially make the current situation even worse? Yes.

Argument:

             I.        How prison isn't working due to overgrowing? If prison isn’t working (for whatever reason), why should we assume that it will work best for the most serious offenders?

            II.        the danger of over-emphasizing physical harm, or the threat thereof, and diminishing the serious nature of other offences, for society as a whole, and the specific negative effects for the legal and criminal justice systems.

          III.        Role of Prison is wider than that simply of physical incarceration and restriction of movement.

          IV.         The effect of this policy is bringing potential harms, e.g. creating a criminal class within society. (violent crimes are more likely to be committed by certain class, e.g. people who are not well educated), or even demarcating crime along racial or cultural lines, particularly when those racial or ethnic groups are also clearly delineated by socio-economic status.

           V.        Any alternative to prisoning automatically diminishes the seriousness of non-violent offence in the eyes of society when set against prison, and thus creating the idea that non-violent crime is always less serious, and undermining the principle of equality of CJS.

          VI.        The effect of this policy on those left within prison is creating violent centers, and long-term overcrowding.

        VII.        Better prison management can solve the problems addressed by GOV, e.g. prisons often have separate wings; why not reserve one exclusively for the use of violent offenders? Separation does not equal removal of certain offenders from prisons.
